I General Provisions
Scope of Application
1. The conclusion of a made-to-order travel planning contract is subject to the terms and conditions outlined below. Any matters not stipulated in these terms shall be governed by applicable laws, regulations, and generally accepted customs.
2. When our company establishes a written special agreement that does not violate laws regulations or disadvantage the customer, that special agreement will take precedence.
Definition of Terms
1. In these terms and conditions, a tailor-made travel package refers to a trip where our company creates and executes a travel plan based on the customer's request specifying the travel destination and schedule, the best transportation or accommodation services available to the customer and the travel fee the customer must pay to our company.
2. The term "telecommunication contract" refers to a customized package travel contract concluded based on applications received via telephone, mail, fax, internet, or other communication methods from card members of our partner card companies. This is a type of customized package travel contract in where the customer has agreed to settle payment according to the member terms of the partner card company. This agreement is applied after the date the travel payments due under the customized package travel contract with our company and the customer agree to pay the travel price, etc., as specified (Travel Price) 2 and (Customer's Right of Cancellation) 1 (Refund of Travel Price) 2.
3. In these terms, the 'card usage date' refers to the date when the customer or our company must make or receive a payment or refund under a customized travel package contract.
Contents of the Travel Contract
In our contract for tailor-made package tours, our company agrees to arrange transportation, accommodation, and other services according to the travel itinerary and to manage the itinerary to ensure customers receive these services.
Arrangement Agent
In fulfilling contracts for bespoke travel arrangements, our company may delegate all or part of the arrangements to other travel agencies, professional arrangers, or assistants.
II Conclusion of a contract
Delivery of the project proposal document
1. Our company listens to our customers' wishes and proposes a travel plan until they are fully satisfied. We provide a planning document detailing the travel itinerary, travel services, travel costs, and other travel conditions based on the request.
2. In our proposal document, the breakdown of the travel fee may explicitly indicate the planning fee as the charge for handling the plan.
Application for Contract
1. Customers who wish to apply for a contract for a customized tour based on the proposal must fill out our application form and submit it with the specified application fee.
2. Customers applying for a made-to-order package tour contract via the Internet or other means must notify us of their affiliated card membership number, etc.
3. The travel fee may be partially applied as a cancellation fee or penalty. Customers who require special assistance during their trip should notify us when applying for the contract. We will do our best to accommodate within reasonable limits. Any costs incurred for special arrangements made for the customer will be customer's responsibility.
Refusal to conclude a contract
Our company may refuse to enter a contract in the following cases.
1. When customer's behavior may cause inconvenience to other guests or disrupt the smooth operation of the trip.
2. When the credit card payment is declined at the time of the contract and payment is not subsequently made.
3. When it is determined that the customer is affiliated with an organized crime group, a company related to an organized crime group, or other anti-social elements.
4. When violent demands, unreasonable requests, threatening behavior, or similar actions are directed toward our company.
5. When a customer spreads false information uses deceit or force to damage our company's reputation or interfere with our business or engages in similar actions.
6. When refusal is necessary for other legitimate business reasons.
Timing of Contract Formation
1. A custom travel package contract is formed when our company accepts the contract and receives the application deposit.
2. The communication contract is deemed concluded when our notification of acceptance of the contract reaches the customer.
Delivery of the Contract Document
1. Immediately after the contract is concluded, we will provide the customer with a written contract specifying the travel itinerary, the contents of the travel services, the travel costs, other travel conditions, and matters concerning our responsibilities.
2. If the project fee is specified in the proposal document, the corresponding amount will be clearly stated in the contract document.
3. The scope of travel services for which our company is responsible for arranging and managing the itinerary under a contract-based organized travel agreement is as set forth in the written contract.
Definitive Document
1. If it is not possible to specify the confirmed travel itinerary or the names of transportation or accommodation providers in the contract document shall list the names of the intended accommodation providers and the transportation providers that are important to the travel plan. After the contract document is issued, a finalized document indicating these confirmed details shall be provided by the date specified in the contract document, which is before the day prior to the start of the trip (or, in the case of a made-to-order travel contract applied for o n or after the seventh day counting back from the day prior to the start of the trip, on the start date of the trip).
2. We will respond promptly and appropriately whenever a customer requests confirmation of the arrangement status.
3. When a written confirmation is issued, the scope of travel services for which our company is responsible for arranging and managing the itinerary is specified in the written confirmation.
Methods of utilizing information and communication technology
1. With the prior consent of our customers, when we provide the information listed in the travel itinerary, the content of travel services, travel fees, other travel conditions, and matters concerning our responsibility—normally delivered in written form, contractual documents, or confirmed documents provided to customers when concluding a proposal document or a made-to-order travel contract-by using information and communication technology instead of delivering these documents, we will confirm that the listed information has been recorded in the file on the communication device used by the customer.
2. If the communication equipment used by the customer does not have a file for recording the described items, we will record the items in our company's customer-specific file and confirm that the customer has viewed the recorded items.
Travel expenses
1. The customer must pay the travel fee stated in the contract by the date specified in the contract.
2. If you pay with a partner company's card over the Internet, the travel fee will be accepted without a signature on the designated slip. In addition, the card usage date will be considered the date of the travel contract conclusion.
III Change of contract
Change of Contract Terms
1. If you wish to change the travel itinerary, travel services, or other details, please let us know. We will do our best to accommodate your request.
2. In cases of natural disasters, unforeseen events, or the suspension of travel services such as transportation and accommodation, which are beyond our control, if it is determined that the safety and smooth execution of the trip are difficult, we may explain the situation to the customer and modify the contract terms. In urgent cases, the explanation may be provided after the changes have been made.
Change in travel price
1. In the event that the fees at the time of presenting the proposal significantly exceed expectations due to remarkable changes in the economic situation, the travel fee may be increased or decreased within the range of the corresponding increase or decrease.
2. If the travel fee is to be increased pursuant to the provisions of the preceding paragraph, we will notify the customer before the 15th day prior to the day preceding the start of the trip, counting backwards from the day before the trip begins.
3. When a reduction is made, only the amount of the decrease will be deducted from the travel fee.
4. If changes to the contract result in an increase or decrease in the cost required to carry out the trip (including cancellation fees, penalties, and other expenses already paid or to be paid for travel services not received), the travel fee may be adjusted within that scope at the time of the contract change (except in cases where the increase in cost is due to a shortage of seat, rooms, or other facilities by transportation or accommodation providers even though they are providing the travel services).
5. If the number of people using transportation or accommodation facilities changes for reasons not attributable to our company, when the contract specifies that the charges vary depending on the number of users, the travel price may be adjusted.
Change of travelers
1. The customer may transfer their contractual position to a third party with the consent of the travel agency with which they have concluded the contract.
2. When a customer seeks to obtain our consent, please fill out the designated form and submit it to us along with the prescribed fee. The transfer of contractual position will take effect only with our consent, and any third party who receives the transferred status under the travel contract will inherit all rights and obligations related to the customer's customized travel contract.
IV Contract termination
Customer's right to cancel
1. The customer may cancel your custom-made package tour at any time by paying us the cancellation fee set forth in appendix 1. When canceling a communication contract, our company will receive payment of the cancellation fee via the partner company's card without the customer's signature.
2. Customers can cancel the contract before the start of the trip without paying a cancellation fee in the following cases.
• When the terms of the contract are changed by our company. However, this applies only to changes listed in the upper column of Appendix 2 or other significant changes.
• When the travel fee is increased based on item 1 (Change in the Amount of Travel Fees).
• In the event of natural disasters, riots, suspension of travel services such as transportation or accommodation facilities, orders from government offices, or other reasons, if it becomes impossible to guarantee the safe and smooth implementation of the trip.
• When our company fails to provide the customer with the definitive document by the specified deadline.
• When it becomes impossible to carry out the travel itinerary stated in the contract due to reasons attributable to our company.
3. If, after trip has begun you are unable to receive the travel services specified in the contract for reasons beyond your control or if we inform you of such you may cancel the contract for the affected services. You will be refunded the amount corresponding to the services you cannot receive. However, if the inability to provide the services is due to reasons outside of our control we will refund you after deducting any cancellation fees, penalties, or other applicable charges for the canceled services.
Our right of cancellation, etc. - Cancellation before the start of the trip
Our company may cancel a custom travel contract before the trip commences, providing the customer with an explanation, in the following circumstances.
1. When it is determined that the customer is unable to undertake the trip due to illness, lack of necessary caregivers, or other similar reasons.
2. When it is determined that a customer may cause disruption to other customers and impede the smooth operation of the trip.
3. When the customer demands a burden that exceeds a reasonable scope regarding the contract terms.
4. When there is a very high possibility that the conditions for conducting trips for purposes such as skiing or cherry blossom viewing will not be met.
5. In the event of natural disasters, riots, suspension of services by transportation or lodging facilities, orders from government offices, or other reasons beyond our control.
6. If the affiliated company's card is invalid for payment on the Internet.
7. (Refusal to conclude a contract) When it falls under items 3 to 5.
Our right to cancel - Cancellation after the start of the trip
Our company may, even after the start of the trip, cancel part of a customized travel contract by explaining the reasons to the traveler in the following cases.
1. When the customer is unable to continue the trip due to illness, the absence of a necessary caregiver, or other reasons.
2. When the customer disrupts group discipline and hinders the safe and smooth execution of the trip due to disobedience of our company's instructions by tour conductors or other staff, or due to acts of assault or threats against these staff or other accompanying customers.
3. (Refusal to conclude a contract) When it falls under items 3 to 5.
4. In the event of natural disasters, riots, suspension of travel services by transportation or accommodation providers, orders from government offices, or other such reasons, when it becomes impossible or extremely likely that the trip cannot be carried out safely and smoothly. If our company cancels a made-to-order travel contract based on the provisions of the preceding paragraph, the contractual relationship between the customer and our company will be terminated prospectively. In such a case, we will refund the amount after deducting any costs that the customer must pay, such as fees for services already provided, cancellation fees, and penalties for services that were supposed to be received.
Refund of travel expenses
1. In the event that the travel fee is reduced pursuant to Articles 3 to 5 regarding changes in the travel fee, or if the made-to-order travel contract is canceled pursuant to Article 3 regarding our right of cancellation after the start of the trip, and a refund becomes due to the customer,
• Refund before the start of the trip: within 7 days from the day following the cancellation of the contract
• Refunds for reductions or contract cancellations after the start of the trip: We will refund the applicable amount to the customer within 30 days from the day following the end date of the trip as stated in the contract document.
2. If our company concludes a contract with a customer via the Internet, and the travel price is reduced in accordance with Articles 3 to 5 of the 'Change of Travel Price' provisions, or if the contract is canceled in accordance with Article 3 of the 'Our Right to Cancel - Cancellation After the Start of Travel' provisions, any amount that should be refunded to the customer will be refunded to the customer in accordance with the relevant credit card company's terms and conditions.
• Refunds for cancellations before the start of the trip: within 7 days from the day following the cancellation.
• Refunds due to reduction or cancellation after the start of the trip: The refund amount will be notified to the customer within 30 days from the day after the travel end date stated in the contract document, and the date the customer is notified will be considered the card usage date.
Arrangement for return trip after contract termination
If our company cancels a customized travel contract after the start of the trip based on Article 1 or 4 (Our right to cancel — cancellation after the start of the trip), we will, at the customer's request, arrange the necessary travel services for the customer to return to the departure point of this trip. In this case, the cost of returning to the departure point will be borne by the customer.
V Group Contract
Group/Organization Contract
Our company will handle the conclusion of organized travel contracts, in which multiple customers traveling the same itinerary simultaneously designate a representative (hereinafter referred to as the contracting officer).
Contract Manager
1. The contract manager shall be deemed to have full authority to represent the conclusion of customized group travel contracts for the customers comprising the group, and all transactions related to travel services concerning the group shall be conducted with the said contract manager.
2. Our company shall not assume any responsibility for any debts or obligations that the contracting officer currently owes or is expected to owe in the future to the group members.
3. The contract manager must submit a roster of the entire group to our company by the date specified by us.
4. If the contract manager does not accompany the group, after the start of the trip, the person pre-designated by the contract manager will be regarded a s the contract manager.
Special provisions after establishment
1. Our company may agree to enter a customized travel package contract with the contracting officer without receiving a deposit, regardless of the provisions of sections 1 and 2 (travel fees).
2. In the case of concluding a made-to-order travel package contract without receiving the application fee based on the provisions of the preceding paragraph, our company shall provide the contract manager with a document stating this fact, and the made-to-order travel package contract shall be deemed concluded when our company issues the document.
VI Itinerary Management
Itinerary Management
Our company strives to ensure that our customers have safe and smooth travel and will perform the following services for them. However, this does not apply if our company has entered into a separate special agreement with the customer.
1. When it is recognized that the customer may not be able to receive travel services during the trip, necessary measures must be taken to ensure that the customer can reliably receive the travel services in accordance with the package tour contract.
2. If it becomes necessary to change the contract despite taking measures to manage the itinerary, arrange alternative services. In such cases, when changing the travel schedule, make efforts to ensure that the revised travel schedule aligns with the intent of the original schedule, and when changing the content of travel services, strive to ensure that the revised travel services are equivalent to the original services, thereby minimizing any changes to the contract content.
Our instructions
Customers must follow our company's instructions for ensuring the safe and smooth execution of the trip when acting as part of a group from the start to the end of the trip.
Duties such as those of a tour conductor
1. Depending on the details of the trip, our company may have tour guides or other personnel accompany you to ensure a safe and smooth journey, and may have them carry out all or part of the tasks that our company deems necessary.
2. The hours during which tour conductors and other personnel engage in their duties shall, as a general rule, be from 8:00 a.m. to 8:00 p.m.
Protective measures
I f w e recognize that a customer traveling with our company requires protection due to illness, injury, or other reasons, we may take necessary measures. In this case, if it is not due to reasons attributable to our company, the costs incurred for such measures shall be borne by the customer, and the customer must pay using the method specified by us by the designated deadline.
VIl Responsibility
Our Responsibility
1. When fulfilling customized tour packages, our company is responsible for compensating customers for damages caused by intentional or negligent acts of our company or those arranged on our behalf by a designated agent, in accordance with applicable regulations. However, this applies only if the customer notifies our company within two years from the day following the occurrence of the damage.
2. I f the customer suffers damages due to natural disasters, riots, suspension of travel services by transportation or accommodation providers, orders from government agencies, or other reasons beyond the control of our company or our contractors, our company shall not be liable for compensation for such damages, except in the cases mentioned in the preceding paragraph.
3. Our company will compensate for any damage arising from the first item concerning baggage up to 150,000 yen per customer within 14 days from the day following the occurrence of the damage (except in cases where our company is at fault due to intent or gross negligence).
Special Compensation
1. Regardless of whether our company bears any responsibility under the provisions of (our company's responsibility, we will pay the predetermined amount of compensation and consolation money for certain damages to the customer's life, body, or baggage incurred during participation in a commissioned type planned trip, as stipulated in the attached special compensation regulations.
2. Regarding the damages mentioned in the preceding paragraph (Our Responsibility, when we are liable based on the provisions of paragraph 1, the compensation payable by us under the preceding paragraph shall be considered as the damages payable under that liability, up to the amount of such damages.
3. In the case provided for in the preceding paragraph, our company's obligation to pay compensation based on the provisions of (Special Compensation) 1 shall be reduced by an amount equivalent to the damages that our company is required to pay under the provisions of (Our Company's Liability), including compensation regarded as damages under the preceding paragraph.
4. For travelers participating in our tailor-made package tours, any optional tours conducted by us for which an additional travel fee is collected will be treated as part of the contract for the tailor-made package tour.
Itinerary Guarantee
1.in the event of a significant change to the contract contents listed in the upper column of Schedule No.2(excluding the following changes (excluding changes due to a shortage of seats, rooms or other facilities at the transportation or accommodation facilities despite the transportation or accommodation facilities continuing to provide the travel services)), our company will pay a change compensation amounting to at least the travel price multiplied by the rate listed in the lower column of the same table within 30days from the day following the end of the trip. However, this does not apply if our company will be liable pursuant to the provisions of 1. (Our Responsibilities) for the change in question.
• Changes due to the following reasons a. Natural disasters b. Warfare c. Riot d. Order from a government office e. Suspension of travel services such as transportation and accommodation facilities f. Provision of transportation services not according to the original operation plan g. Necessary measures to ensure the safety of the life or body of travel participants
• (Changes to the Contract) Changes related to the portions of a customized travel contract that have been modified based on the provisions of 1., and changes related to the portions of a customized travel contract that have been canceled based on the provisions from (Customer's Right to Cancel) 1. to (Our Right to Cancel-Cancellation After the Start of Travel).
2. The amount of compensation for changes that our company is required to pay shall be limited to an amount calculated by multiplying the travel price by a rate of 15% or more as determined by our company for each customized travel contract per customer. Furthermore, if the amount of compensation for changes payable for each customized travel per customer is less than 1,000 yen, our company will not pay the compensation.
3. If, after our company has paid the change compensation based on the provisions of Section 1, it becomes clear that our company has liability (our responsibility) under the provisions of Section 1 regarding the relevant change, the customer must return the change compensation related to that change to our company. In this case, our company will pay the balance obtained by offsetting the number of damages that our company should pay under the provisions of Section 1 against the amount of change compensation that the customer must return.
Customer's Responsibility
1. If our company suffers damage due to the customer's intentional or negligent actions, the customer must compensate for the damage.
2. When entering a customized travel contract, customers must make efforts to understand the rights, obligations, and other contents of the customized travel contract by utilizing the information provided by our company.
3. After the start of the trip, if the customer recognizes that the travel services provided differ from those described in the contract documents, they must promptly report this to our company, our arrangement agents, or the relevant service provider at the travel destination in order to smoothly receive the travel services as stated in the contract documents.

Note 1: Before the start of the trip' refers to the case where the traveler is notified of the change by the day before the start of the trip, and 'after the start of the trip' refers to the case where the traveler is notified of the change on or after the day the trip begins. Note 2: When a definitive document is issued, this table shall be applied by reading any reference to 'contract document' as 'definitive document.' In this case, if there are changes between the contents described in the contract document and those in the definitive document, or between the contents of the definitive document and the actual travel services provided; each such change shall be treated as a separate instance. Under the Travel Agency Act, regardless of the responsibility of the travel agency, it is mandatory to pay special compensation if a traveler suffers bodily injury due to a 'sudden and accidental incident' during participation in a group-arranged or individually arranged tour, or if the traveler's personal belongings are damaged due to an incident occurring during the trip. This is different from the travel accident insurance that travelers themselves usually sign up for. At Elite Tours Co., Ltd., we prioritize our customers' safety and will cover the cost of the Zenryo Insurance' on your behalf.
